Trial Timing Puzzle: Anticipating Chutkan’s Call

Making an appearance on MSNBC’s “The Katie Phang Show” in the early hours of Saturday morning, former federal prosecutor Glenn Kirschner asserted that the proposal put forth by Donald Trump’s legal team to postpone the trial until 2026 is poised to face a decisive rejection from U.S. District Court Judge Tanya Chutkan of the District of Columbia, come Monday.

During the conversation with the host, Kirschner concurred with both the host, Katie Phang, and fellow panelist Hugo Lowell of the Guardian, in characterizing the motion presented by the former president’s attorneys as utterly “ludicrous.”

Responding to Phang’s inquiry about his expectations for Monday’s proceedings, Kirschner elaborated, “Katie, seeking to secure a trial date as distant as April 2026 within the realm of federal court is not merely laughable but can aptly be described as absurd. Envisioning what transpires on Monday, in light of Judge Chutkan’s perspective, aligns with the sentiments shared. The legal maneuvering undertaken by Donald Trump’s defense counsel lacks authenticity and gravitates more towards their roles as auxiliary campaign strategists for Donald Trump.”

“Considering the circumstances, it becomes apparent that the most rational voices within the discourse are those of [special counsel] Jack Smith and his contingent of federal prosecutors. In my estimation, these voices embody reason. Therefore, the inclination is for Judge Chutkan to incline towards their recommendations.”

“Anticipating the trajectory, it is plausible that Tanya Chutkan will opt to schedule a trial date for the early months of 2024. This would, in effect, ensure a resolution of this case well ahead of the presidential election scheduled for November 2024,” Kirschner prognosticated.
